The Supreme Court yesterday, under the name of Sanders, voted 5-4 to kill a guy.
Anytime the court takes a case from the 9th circuit, look out.
O'Connor was the swing vote, the vote to let the guy swing.
The timing could hardly be worse, coming in the middle of the alito hearings.
It's a reminder that life and death are at stake in who gets named to the court, and every vote counts.
But alito's doing well in the hearings and should skate through, with or without a filibuster.
