well it was 3 hours ago but i had to change a flat tire and read the opinion
This just in! The Supreme Court today decided it last three cases for the year. Two of them are big, 5-4 conservatives over liberals.
In DC v Heller, Justice Scalia upheld the 2nd Amendment in a historic landmark opinion.
In Davis v FEC, Justice Alito found McCain Feingold's millionaire amendment unconstitutional.
That's it for us till October. We iz gettin' drunk tonight!
Prediction: the Heller case will help sink Obama. People will worry he would try to appoint judges to roll back this civil rights victory.
Scalia did make one little error: he said that Miller, in US v Miller, was convicted. False.

Wouldn't it have been upheld regardless of the way the Justices interpreted it?

arbi says:

No, the 4 dissenters would have reversed the DC circuit, denying any practical effect to the 2nd A.
