this was just in yesterday. so far there hasn't been any big blockbuster case to end the term. the excitement is more about some cases they will hear next fall, about gerrymandering.
In PTO v Tam, decided yesterday, the court held that for First Amendment reasons, the Patent office couldn't deny a trademark to the Slants, a asian boy band,
on the basis that Slants is an ethnic slur. The Slants are trying to reclaim is, or use it ironically, or something like that. Re-appropriation.
The lineup was unsual. They all agreed, but there was a 4-4 split anyway, on some parts of the opinion,so it is a tnagled web of which opnion actually controls. Gorsuch abstained, and Thomas partially
dissented, but only to say certain issues need not hqave been reached.
Justice Ginsberg concurred in an 8 page opion in Chinese, a first for th court. Or not.
